Supreme Court decision changes the composition of the Assembly.
The Supreme Federal Court (STF) decided yesterday (10) that only the Municipal Chambers have the power to disapprove the government accounts of municipal mayors. With this decision, the votes of the former mayor of Horizonte, José Rocha Neto, a candidate for state deputy in 2014, were included in the general count of valid votes, altering the electoral quotient. The composition of the Legislative Assembly of Ceará should undergo a change. Deputy Audic Mota (PMDB), from the opposition, will lose his seat to Deputy Prof. Teodoro (PSD), from the government base. For the Camilo Santana government, this is a reasonable gain since Audic Mota is one of the main voices of the opposition in the Legislative Assembly.
Ceará 247 - The Supreme Federal Court (STF) decided today (10) that mayoral candidates whose accounts were rejected only by the Courts of Auditors can run in the October elections. According to the STF's understanding, candidates can only be barred by the Clean Record Law if their accounts are rejected by the municipal chambers.
By a vote of 6 to 5, the majority of ministers understood that the court's decision disapproving of the government's accounts should be treated only as a preliminary opinion, which must be reviewed by the city councilors. With this decision, the votes of the former mayor of Horizonte, José Rocha Neto, a candidate for deputy in 2014, were included in the overall count of valid votes, altering the electoral quotient.
The new calculation benefits substitute deputy Prof. Teodoro (PSD), who will be confirmed in the seat. Audic Mota (PMDB) loses his seat and becomes the first alternate. For the government, this is a reasonable gain since Audic Mota is one of the main voices of the opposition in the Legislative Assembly, and Prof. Teodoro is part of the government's base.
The issue reached the Supreme Court through an appeal filed by José Rocha Neto. His candidacy was blocked because his accounts were rejected by the Court of Accounts of Municipalities of Ceará, during his time as mayor of Horizonte. After the disapproval, the City Council did not follow the court's opinion and approved the accounts. Running again in Horizonte, José Rocha Neto will be able to contest the 2016 elections without problems under the Clean Slate Law.
