The rape case occurred when Cuca was 24 and had just joined Grêmio, which was on a European tour. He and three other players were arrested at a hotel in Bern, accused of sexually assaulting a girl. Cuca was sentenced to 15 months in prison and ordered to pay $8.000, the same penalty applied to the other players involved.
Cuca failed to appear in Switzerland to defend himself or serve the sentence stipulated for the crime, which eventually expired.
