Liana Cirne Lins: "Bolsonaro is almost on his way to Papuda prison"
Legal expert predicts the fate of former president in interview, who faces trial at the Supreme Court this Tuesday. Watch on TV 247.
247 - Lawyer Liana Cirne Lins assessed, in an interview with TV 247, that the trial of Jair Bolsonaro for leading the coup plot, which takes place this Tuesday (9), in the First Panel of the Supreme Federal Court (STF), will lead the former president to the Papuda Penitentiary Complex.
"Bolsonaro could be sent to Papuda prison," Liana said on Bom Dia 247 this Tuesday. According to her, the former president, who is a defendant and is under house arrest, "does not meet any of the requirements for house arrest."
In the interview, Liana also commented on the role of the governor of São Paulo, Tarcísio de Freitas, who decided to defend Bolsonaro and the amnesty for those involved in the coup plot. "You can't say that Tarcísio is from the 'nice right'," she assessed.
THE TRIAL
This Tuesday, the First Panel resumes the trial that could convict Bolsonaro and seven other allies for a coup plot allegedly aimed at reversing the results of the 2022 elections.
The group is part of the crucial core of the complaint filed by the Attorney General's Office (PGR), formed by the main ringleaders of the conspiracy.
The trial began last week, when arguments were heard from the defense attorneys for the former president and the other defendants, in addition to the statement from the Attorney General of the Republic, Paulo Gonet, who was in favor of convicting all the defendants.
Starting today, voting will begin to determine whether the defendants will be convicted or acquitted. Sessions have been scheduled for September 10th, 11th, and 12th to finalize the trial.
Until next Friday (12), they must vote, in this order: the rapporteur, Minister Alexandre de Moraes (rapporteur), and Ministers Flávio Dino, Luiz Fux, Cármen Lúcia and Cristiano Zanin, president of the collegiate body and who presides over the session.
Who are the defendants?
Jair Bolsonaro – former President of the Republic;
- Alexandre Ramagem - former director of the Brazilian Intelligence Agency (Abin);
- Almir Garnier - former commander of the Navy;
- Anderson Torres - former Minister of Justice and former Secretary of Security of the Federal District;
- Augusto Heleno - former Minister of the Institutional Security Cabinet (GSI);
- Paulo Sérgio Nogueira - former Minister of Defense;
- Walter Braga Netto - former Minister of Defense and Bolsonaro's running mate in the 2022 election;
- Mauro Cid – Bolsonaro’s former aide-de-camp.
Crimes
All defendants are charged with the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup d'état, aggravated damage through violence and serious threat, and deterioration of listed heritage.
The exception is the case of former ABIN director Alexandre Ramagem, who is currently a federal deputy. He benefited from the suspension of some of the charges and is only facing charges for three of the five crimes. This rule is stipulated in the Constitution.
The suspension applies to crimes of aggravated damage through violence and serious threat, against the assets of the Union, with considerable harm to the victim and deterioration of listed property, related to the coup attempts of January 8th.
