"Contracting for Food Products for States and Municipalities"This material, developed in partnership between Sebrae and the National Front of Mayors (FNP), according to information from Agência GovBr, details in a practical way the procedures foreseen in Provisional Measure No. 1.309/25, which is part of the Sovereign Brazil Plan — a federal government initiative aimed at supporting Brazilian companies impacted by the recent 50% increase in export tariffs imposed by the United States. The measure establishes emergency actions to facilitate the acquisition, by states and municipalities, of food products that have ceased to be exported, creating a new channel for the flow of production and strengthening food security in the country.
According to the technical director of Sebrae, Bruno Quick, the guide serves as an essential tool for public managers to act with agility and efficiency in the face of the new scenario. "If there is one instrument that the Brazilian State possesses to induce development, it is the use of purchasing power. There is nothing as powerful as that," he emphasized.
Quick emphasized that approximately 16% of the national Gross Domestic Product (GDP) corresponds to public contracts from all levels of government—federal, state, and municipal. "This measure seeks to create a market to ensure the continuity of production and promotes culture, local development, and, above all, food security for the people who live in the municipality," he added.
In addition to presenting a practical interpretation of the Provisional Measure, the publication provides technical and methodological guidance to assist states and municipalities in carrying out public procurement. “Count on Sebrae. This is a practical response to our partnership and demonstrates the capacity for mobilization from the municipalities, our preferred partners,” stated the director.
The content of the guide identifies the main buyers — bodies and entities of the public administration of the Union, states, Federal District and municipalities, according to Law No. 14.133/2021 — and defines the eligible suppliers: producers and exporting companies harmed by the tariffs, provided they present proof of losses through declarations.
Among the products eligible for participation in public procurement are honey, mango, grapes, açaí, Brazil nuts and cashew nuts, coconut water, and fish such as tilapia, corvina, and snapper.
To facilitate the acquisition, municipalities may exceptionally waive the bidding process by means of a simplified terms of reference containing essential information. Prices must be defined based on the average of quotations from eligible suppliers, and contracts must be signed by the beginning of February of next year.
The guide also includes document templates — terms of reference, legal opinion, contract draft, and forfeiture declaration — and reinforces the importance of transparency and publicity of administrative acts, as provided for in the Law on Bidding and Administrative Contracts (Law No. 14.133/2021).
With this initiative, the federal government seeks to ensure that the public sector contributes to sustaining national production affected by external restrictions, while also guaranteeing food supply and stimulating local economies.
