Union sees irregularities and promises to file a lawsuit against the privatization of Eletrobras.

247 - Union leaders denounce irregularities in Michel Temer's proposed sale of Eletrobras and promise to file a lawsuit against the privatization of the company's distribution companies.

On Tuesday the 3rd, union members and members of social movements gathered in front of the company's headquarters in Rio de Janeiro, in an act defending Brazilian state-owned companies and national sovereignty. The march continued to Petrobras headquarters and took over Avenida Rio Branco.

Last week, the Eletrobrás Workers' Association (AEEL) released allegations regarding the privatization process of the distribution companies, involving the company's president, Wilson Ferreira.

According to the organization, even after the allegations about the illegal participation of his right-hand man Oscar Salomão in the privatization process of the distribution companies, which had already been made by the association, Oscar returned to the company to gain access to the final data sent by BNDES to Eletrobrás.

According to AEEL, Oscar's repeated irregular involvement, linked to 3G Radar and Elena Landau, will be grounds for a lawsuit that could disrupt the company's plans.

"The thirst for confidential data is so great that Oscar had already clashed with BNDES by requesting access to the data in advance, even going so far as to coordinate with the Ministry of Mines and Energy (MME) a ​​request to change the managers of the process at BNDES. Apparently, he had to wait for the data to reach Eletrobras to gain access," the association denounces in a statement.

"Oscar returned to finish his work for 3G. The aggravating factor is that Oscar no longer has any connection with Eletrobras, and his participation calls into question the integrity of the privatization process. The collusion between 3G and the company's president, Wilson Ferreira, is becoming increasingly clear. The privatization process is repeating old habits," the text continues.

BTG and the sale of SPVs

The National Federation of Urban Workers (FNU) also denounced this week the irregular hiring of BTG Pactual to act in the sale of Eletrobras' stakes in Special Purpose Entities (SPEs).

According to the union, there were two problems with the contract. On the one hand, since it is a service offered by several banks and specialized companies, the contract should have been awarded through a bidding process.

By order of the company's president, Wilson Ferreira, the contract was awarded without bidding, and the company that offered R$ 5 million was chosen, the highest price among the 3 companies consulted (a value at least 35% higher than that offered by the second-placed company).

The union also claims there is a conflict of interest, since BTG owns an energy trading company, holds 36% of the shares of the energy company ENEVA, and has a stake in Equatorial Energia.

Furthermore, the union leaders added that there is suspicion that BTG is using confidential company data to disseminate reports favorable to the privatization of Eletrobras, which were then published by the mainstream media.
