Revenue announces rules for this year's Income Tax Declaration

The deadline for filing the tax return is from March 7th to April 29th. Filing is mandatory for those who received more than R$ 28.559,70 in taxable income.

Brazil Agency - The Federal Revenue Service announced today (24) some changes that may make it easier to file this year's Income Tax (IR) return, which is based on the year 2021. The period for submitting returns will be between March 7 and April 29, and refund batches will begin on May 31, divided into five monthly groups until September 30. The Revenue Service expects to receive 34,1 million documents by the deadline.

This year, citizens who had taxable income in 2021 worth more than R$28.559,70 are required to file a tax return. In the case of income considered “exempt, non-taxable or taxed exclusively at source”, those who received an amount greater than R$40 are required to file a tax return.

Tax auditor José Carlos da Fonseca, responsible for the 2022 Income Tax program, reminds us that emergency aid is among those considered taxable. “If a person received emergency aid in addition to their salary, and the sum of these taxable incomes exceeds the limit [R$28,5], they will be required to file an income tax return. This doesn't mean they are obligated because of the emergency aid itself, but because, as this aid is taxable income, when added to other taxable income and exceeding the limit defined by the rule, it obligates the citizen to file a return,” said the auditor, detailing the new rules defined by the Internal Revenue Service.

“Similarly, this will apply to those who received exempt, non-taxable, or exclusively taxed at source income exceeding R$ 40.” This is the case, for example, of individual micro-entrepreneurs (MEIs) who received exempt income above this limit. “The declaration becomes mandatory not because they are MEIs, but because they received income above the legal limit,” he added.

Those who have had capital gains from the sale of assets or rights subject to taxation are also still required to file a tax return, as are individuals who are entitled to an exemption from capital gains tax on the sale of residential properties, followed by the acquisition of another residential property within 180 days; and individuals who have traded on stock exchanges.

Those who, on December 31, 2021, owned assets or rights, including bare land, worth more than R$300 are also required to declare; and people who, in rural activities, received taxable income worth more than R$142.798,50.

Centenary of IR

The Undersecretary of Collection, Registration and Service, Frederico Faber, announced some facilities prepared for this year, which marks 100 years since the creation of Income Tax in Brazil.

“The IRS has prepared a package of innovations that simplify the process of filling out the declaration, paying the tax and receiving the refund. The biggest of these is the availability of pre-filled declarations on a large scale for taxpayers, based on authentication via Gov.br accounts,” said the auditor.

A Gov.br account is a digital identifier that verifies a citizen's identity, providing secure access to digital services. It is free, and both registration and access can be done online.

The activation of income tax services with the Gov.br account will begin on March 3rd, as will be presented in Normative Instruction No. 2.065, which will be published on [date]. Official Gazette tomorrow (25).

According to tax auditor Juliano Neves, the pre-filled tax return will allow citizens to begin filling out the document with a wealth of information already available. "With it, virtually all the information held by the tax authorities will be imported directly into the return," he said.

“For example, information on income paid by companies and other individuals; medical expenses reported by medical establishments; and the history of assets and rights from previous years' tax returns. Thus, those who use this feature have less chance of making mistakes in filling out the form and being flagged for review. It also allows them to receive their refund more quickly. And, for those who have taxes to pay, it means greater peace of mind in knowing that they are paying their taxes correctly,” he added. Last year, there were 400 pre-filled tax returns. For this year, the IRS forecasts between 3 million and 4 million.

Another new feature is the new multi-platform IRPF (Brazilian Individual Income Tax Return) format, available for both computers and computers. online as well as for mobile devices. According to Neves, the program will be even more integrated this year. "It will be possible, for example, to start the declaration on the cell phone, continue in the program installed on the computer and finish on the internet," he said.

Another new feature is the possibility for citizens to pay their income tax installments via Pix, as well as receive their refunds via the transfer system. “This brings more agility and security to transactions with the Federal Revenue Service, in addition to simplifying procedures. In practice, it also means that citizens will no longer need to leave their homes to pay their DARF [Federal Revenue Collection Document] or any other integration,” explains Neves.

José Carlos da Fonseca added that all DARFs will now be printed with barcodes and query code to facilitate payments via Pix.
