"Lunatic thesis," says Gilmar Mendes regarding the defense of military intervention based on an article of the Constitution.

"This thesis is a lunatic's thesis and a lunatic's trip," said Supreme Court Justice Gilmar Mendes. Article 142 of the Constitution has been used by Jair Bolsonaro and his allies to defend the closure of institutions such as the Supreme Court itself and the National Congress.

247 - Brazilian Supreme Court Justice Gilmar Mendes said that a "great madness" has taken hold in the country and that defending Article 142 of the Constitution to justify a military intervention "is a lunatic's thesis." "I think a great madness, a great confusion, has taken hold in the country. This thesis is the thesis of lunatics and it's a lunatic's trip," said Gilmar Mendes during an online interview broadcast by the newspaper. Valor Econômico, this Wednesday (3). “I think it’s completely irresponsible. It’s an irresponsible interpretation that assigns the role of interpreting the Constitution to the Armed Forces,” he added. 

The minister also disagreed with the statement made by the Attorney General of the Republic, Augusto Aras, that article 142 "establishes that the Armed Forces must guarantee the functioning of the constituted Powers, this guarantee being within the limits of the competence of each Power". 

"If you read article 142, it says nothing about that, much less authorizes what Aras reproduced in a..." interview "On Bial's show 'Conversa com Bial,' broadcast by Rede Globo, he said that the Armed Forces guarantee the Powers. No. The Guardian of the Constitution is the Supreme Federal Court," Mendes stated.
