247 - Sony says it will sue federal deputy Tiririca, candidate for re-election by PR, for copyright infringement, due to the parody of the song "O Portão", by Erasmo and Roberto Carlos, in his campaign. Sony's lawyer, José Diamantino, told G1 this Thursday (21) that he sent a notification to Tiririca to ask for the suspension of the use, but received no response. He considered the act an "affront".
The lawyer for Tiririca's party, PR, Ricardo Vita Porto, says that Tiririca's campaign is "astonished" by the publisher's reaction and does not consider that there was any undue exploitation of copyright. He stated that the version of the song "is a parody, which is permitted by law."
In a video broadcast on TV this week, Tiririca appears dressed as Roberto Carlos and sings: "I voted, I'll vote again. Tiririca, Brasília is your place" (to the tune of the song "O Portão"). In the election advertisement, Tiririca is seated at a dining table and shows a steak, referencing the Friboi company commercial that starred Roberto Carlos. "What big steaks, man," says the comedian and politician.
José Diamantino sent a notification to YouTube denouncing the improper use of the music in the video that was published on the site. YouTube took the video down on Wednesday (20), and indicated on the page the copyright claim of EMI (the publisher is currently part of the music publishing group controlled by Sony).
According to the publisher's lawyer, in addition to demanding the suspension of the song for copyright infringement, a claim for compensation for moral damages against Roberto Carlos may also be applicable in this case. However, he said that Sony will still consult with Roberto Carlos about this possible claim. The singer is currently on an international tour promoting the song "Ese tipo soy yo" in the Latin market and has not yet commented on the matter.
