Rosa Weber orders the suspension of lifetime pension payments to former governors Edison Lobão and José Reinaldo Tavares.

The decision was made in response to a request from the government of the State of Maranhão.

247 - The Vice-President of the Supreme Federal Court (STF), Minister Rosa Weber, decided to suspend decisions by the Court of Justice of the State of Maranhão that reinstated the payment of lifetime monthly pensions to former governors Edison Lobão (MDB; 1991-1994) and José Reinaldo Carneiro Tavares (PSDB; 2002-2006). The decision responded to a request made by the State of Maranhão, which argued that the payment of the benefits offends the administrative-constitutional order and the public economy, and violates a decision of the Supreme Court.

According to the newspaper The State of S. PaulThe minister saw a 'discrepancy' between the rulings of the state court and the understanding of the Supreme Federal Court (STF), which declared the unconstitutionality of rules that provided for the granting of a lifetime monthly allowance to former governors. 

"The issue is no longer controversial, as the understanding has been settled, in the context of abstract review, in the exact case of the declaration of unconstitutionality of state regulations providing for the payment of lifetime pensions to former governors, that 'acquired rights do not constitute a valid basis for preserving the receipt of said lifetime pension, especially when based on an unconstitutional provision'," Weber said in the decision.
