TV 247 - The Boa Noite 247 program this Wednesday (18) highlighted the statement by Minister Dias Toffoli, the next president of the Supreme Federal Court (STF), insinuating that he will keep Lula incarcerated, the TSE's decision to veto the MBL action and the conviction of Eduardo Cunha's wife, Cláudia Cruz, by the TRF-4.
Minister Dias Toffoli declared to Folha de S.Paulo that the presidency of the Supreme Court often leads those holding the position to vote against their own convictions, in defense of the institution.
According to journalist Paulo Moreira Leite, the minister should keep that kind of opinion to his psychoanalyst or family member. "This is not something you say in an interview. At the very least, he should have the courage to say that he will uphold the constitution," he states.
Journalist Alex Solnik believes that such a statement would be to lessen the pressure the minister has been under from the right wing, so that he does not intercede favorably on Lula's habeas corpus. "Obviously we know what his position is, which is imprisonment only after the final judgment," he says.
Brazil's Superior Electoral Court (TSE) rejected a lawsuit filed by the Free Brazil Movement (MBL) seeking to disqualify former President Lula from running for office immediately. Solnik asserts that the group's purpose is to undermine democracy. "They are empty-headed, they immediately resort to aggression, they have no substance whatsoever," he observes.
The TRF-4 (Regional Federal Court of the 4th Region) overturned a decision by Judge Sérgio Moro, who had acquitted Cláudia Cruz, wife of former federal deputy Eduardo Cunha, of the crimes of money laundering and tax evasion. The Porto Alegre court convicted the journalist of the crime of tax evasion.
