Brazil's Attorney General sees no crime in Lula calling Bolsonaro a 'genocidal maniac'.

Lula's statements during the campaign are a matter of political responsibility, not legal responsibility, argues the Attorney General's Office.

247 - The Attorney General's Office (PGR) has presented a defense to the Supreme Federal Court (STF) regarding the dismissal of an investigation request made by Jair Bolsonaro (PL) against President Lula (PT) and the president of the PT, Gleisi Hoffmann.

During the 2022 election campaign, Bolsonaro claimed to have been the victim of a crime against his honor, being associated with the death of councilwoman Marielle Franco (Psol-RJ) and called a "genocidal maniac".

According to the document presented by the former head of the Executive branch, Lula allegedly used rallies and electoral propaganda to defame him, using expressions such as "militiaman" and "demon," with the intention of tarnishing his honor.

The Deputy Attorney General of the Republic, Lindôra Araújo, stated that the expressions used by Lula had a political-electoral connotation and not a legal-penal one, making it clear that it was not a crime against honor.

“It is along these lines that the words highlighted above were used, that is, to attribute a political responsibility and not strictly a legal one,” the Attorney General’s Office continued on Wednesday (8). “There was, clearly, no attribution of the crime of genocide in the penal sense.” 

Lindôra also emphasized that Lula could not be investigated for acts unrelated to his mandate. (Article written with the support of artificial intelligence).
