Brazil's Attorney General's Office is investigating Dallagnol for the Lava Jato Foundation.
The Attorney General's Office's internal affairs division has opened an investigation into the actions of Lava Jato prosecutors who attempted to create a fund of R$ 2,5 billion from fines paid by Petrobras; one of the main targets of the investigation is prosecutor Deltan Dallagnol, the mastermind and spokesperson for the now-thwarted initiative; Dallagnol's audacity was such that he was already negotiating with Caixa Econômica Federal (CEF) alternative investments for the R$ 2,5 billion.
247 - The internal affairs department of the Attorney General's Office (PGR) has opened an investigation into the actions of Lava Jato prosecutors who attempted to create a fund of R$ 2,5 billion from fines paid by Petrobras. One of the main targets of the investigation is prosecutor Deltan Dallagnol, the mastermind and spokesperson for the now-thwarted initiative, according to reports. Monica BergamoAccording to journalist Luis Nassif, Dallagnol's audacity was such that he was already negotiating investment alternatives for the R$ 2,5 billion with Caixa Econômica Federal (CEF).
According to the GGN newspaperOn January 25th, CEF, through its legal department and the vice-presidency of Government Funds and Lotteries, responded to a request from Dallagnol and informed him that until "the ownership of the funds was defined, they would be remunerated at 100% of the Selic rate," less the administration fee.
After the foundation is established, "the administration fee would be 0,10% per year" and "the resources could be invested in post-fixed government bonds or in CDBs (Certificates of Deposit). Or a wide range of investment funds," the report says.
For Carol Proner, a member of the Brazilian Association of Jurists for Democracy (ABJD), the fact is "extremely serious." "This is extremely serious! The lead prosecutor in the Lava Jato operation, Deltan Martinazzo Dallagnol, negotiated alternative ways of remunerating Petrobras' money," she posted on Twitter.
The creation of the Lava Jato Foundation was widely criticized and ended with a request for the annulment of the agreement by the Attorney General of the Republic, Raquel Dodge. Faced with the pressure, the prosecutors ended up backing down and abandoning the creation of the fund to manage the resources.
Dodge considered the founding of Lava Jato as a "violation of fundamental and structural rights of the Republic of Brazil" and that the prosecutors do not have the legal and constitutional powers to sign an agreement of an administrative nature. (Read more at...) Brazil 247).
