Brazil's Attorney General says that members of Congress cannot request the arrest of Eduardo Bolsonaro.
According to Paulo Gonet, only the Public Prosecutor's Office, the Federal Police, or an assistant prosecutor can request this measure.
André Richter, reporter for Agência Brasil - The Attorney General of the Republic, Paulo Gonet, sent this Tuesday (14) to the Supreme Federal Court (STF) an opinion in which he affirms that parliamentarians cannot request the arrest of deputy Eduardo Bolsonaro (PL-SP).
The opinion was sent to Minister Alexandre de Moraes after deputies Lindbergh Farias (PT-RJ) and Talíria Petrone (PSOL-RJ) requested the arrest of the son of former president Jair Bolsonaro, who is being investigated by the Court for the United States' tariff increases against Brazilian exports.
According to Gonet, only the Public Prosecutor's Office, the Federal Police, or an assistant prosecutor can request this measure.
"Their Excellencies are not qualified to act in any of these positions, which deprives them of the procedural standing to litigate in the case," he stated.
However, the prosecutor said he may consider issuing precautionary measures against Eduardo Bolsonaro.
"In any case, the Attorney General's Office reserves the right to assess, at a time it deems appropriate, any request for precautionary measures, including with regard to the aspect of their actual feasibility," he added.
Last month, Gonet filed a complaint against Bolsonaro's son and blogger Paulo Figueiredo for the crime of coercion during legal proceedings.
Both reside in the United States and were investigated in the inquiry that looked into their involvement in promoting the tariff hike against Brazil and sanctions against members of the federal government and the Supreme Court.
