Nunes Marques dismisses lawsuit against public defender who celebrated the terrorist acts of January 8th.

247 - On March 23, Supreme Court Justice Nunes Marques ordered the dismissal of the case against public defender Ana Lúcia Bagueira for celebrating the terrorist acts of January 8th on her social media. In the decision, made unilaterally, Nunes Marques, who was appointed to the position by Jair Bolsonaro, argued that the Supreme Court does not have the necessary jurisdiction to judge the lawyer. The minister emphasized that Bagueira had no direct or indirect involvement in the terrorist acts, limiting herself only to publishing a statement on her social media.

The defender wrote “The day has arrived!!! Happy people!!!” in a photo of the sculpture “Justice”, installed in front of the STF (Supreme Federal Court), which was defaced by Bolsonaro supporters with the phrase “You lost, sucker”. 

"The statement does not convey any praise, commendation, or glorification of the crimes committed by those responsible for the invasion and the damage caused to public property," wrote Nunes Marques. 

Regarding the public defender's insults against President Lula and Supreme Court Justice Alexandre de Moraes, Nunes Marques stated that it is up to the Ministry of Justice and Moraes to decide whether or not to file a lawsuit against Bagueira.

"It is my duty, at this time, to inform the Minister of Justice and Minister Alexandre de Moraes of the content of the initial petition, so that, if necessary, the former may submit a request and the latter may submit a formal complaint or criminal charge, in order to enable the possible future initiation of criminal proceedings," said Nunes Marques in the decision.

Nunes Marques' decision was forwarded to the Attorney General's Office, which did not contest it.
