"No one can be punished for even thinking," says Fux in the trial of the central figures in the coup plot.

The Supreme Court Justice expressed a series of disagreements with previous votes.

247 - Minister Luiz Fux, of the Supreme Federal Court (STF), argued this Wednesday (10) that preparatory acts for the execution of a crime should not be analyzed in the judicial sphere. 

"The violent conduct must constitute an act of execution," said Fux during the trial of the first group in the coup plot, which has former president Jair Bolsonaro as its leader, in the First Chamber of the Supreme Federal Court.

Citing a legal scholar, Fux said: "Criminal thoughts and desires, although subject to religious and moral criteria, escape punitive law."

"No one can be punished for contemplating," he stated, adding that preparatory acts cannot be considered attempted crimes.
