Minister Alexandre de Moraes, of the Supreme Federal Court (STF), suspended this Friday (10) your own decision which dismissed the legal representation of Filipe Martins and Marcelo Câmara, former aides to Jair Bolsonaro. Both are defendants in the second phase of the coup plot.
Martins filed a petition with the Supreme Federal Court. A handwritten note contesting the dismissal and stating that he does not accept being defended by the Federal Public Defender's Office (DPU), as ordered by the minister.
In the new decision, Moraes gave lawyers Jeffrey Chiquini and Eduardo Kuntz, who had been dismissed, 24 hours to file their final arguments, the last step before the trial of the criminal case.
"I hereby temporarily suspend the effects of the decision of 9/10/2025 and grant a period of 24 hours for the defense of Filipe Garcia Martins Pereira to remedy the absence of final arguments not filed within the legal deadline," Moraes ruled.
The minister also determined that the Supreme Court's judicial secretariat must certify this Saturday (11) the end of the deadline for submitting allegations.
Understand
According to the minister, the defense did not present its final arguments and behaved in an "unusual" manner in an attempt to delay the process. The deadline given by Moraes ended on Tuesday (7).
"The behavior of the defendants' lawyers is absolutely unusual, even constituting bad faith litigation, due to the admission of an intention to delay the proceedings, without any legal basis," said Moraes.
With this decision, the minister determined that the defendants' defense will be handled by the Public Defender's Office.
Other side
Following the decision, the defense stated that they had not missed the 15-day deadline to submit their arguments.
Jeffrey Chiquini said that the Attorney General's Office (PGR) has added new elements to the case and, therefore, the deadline has not yet expired. The lawyer considered Moraes' decision "arbitrary."
Kuntz said that the allegations will be delivered by October 23rd, meeting the 15-day deadline. According to the lawyer, the deadline began counting from October 8th, the date on which a request for information submitted by the defense and authorized by Moraes was added to the case file.
In a statement, the Brazilian Bar Association (OAB) said it is evaluating the case. "The facts will be analyzed calmly and responsibly. If violations of the guarantees of defense or the prerogatives of the professionals involved are identified, the Order will act to ensure their professional dignity, within the limits of legality and with the institutional respect that the matter demands," the entity declared.
