247 - Brazilian Supreme Court Justice Alexandre de Moraes has ordered the Federal Police to comment on the need to keep the assets seized from Army Lieutenant Colonel Rafael Martins de Oliveira. At the time of his arrest, the Federal Police seized several items, including cell phones and computers, and Oliveira's defense is now requesting the return of the items, questioning the legality of their retention for more than a year.

The request was made by Oliveira's lawyers on Monday (10), who argued that maintaining the seizure of the assets is "unjustified" due to the long period of retention without proof of current interest for the progress of the investigations. According to the request, "maintaining the seizure of the assets is not justified, mainly due to the passage of a long interval of 1 year, with no current interest in such a measure for the instruction of the investigation".

In his decision, Moraes established a five-day deadline for the Federal Police to comment on the need to keep the assets in custody. The opinion must also be sent to the Attorney General's Office (PGR), which will have the same deadline to issue its position. The case involves Lieutenant Colonel Oliveira, a member of the Army's Special Forces, known as "Kid Preto," who was arrested in the context of investigations into an attempted coup aimed at preventing the inauguration of President Luiz Inácio Lula da Silva (PT) in 2022.

Rafael Martins de Oliveira was the target of a Federal Police operation in February of last year, when he was under house arrest. He was subsequently placed in pre-trial detention in November 2024 and is currently being held in a military penitentiary in Rio de Janeiro. Investigations indicate that he was one of those involved in a plan to assassinate President Lula, Vice President Geraldo Alckmin, and Minister Alexandre de Moraes himself, as part of a coup conspiracy aimed at preventing the Lula-Alckmin ticket from taking office.

According to the Federal Police, Oliveira was part of a scheme called "World Cup 2022," in which, using a codename, he allegedly orchestrated the assassination of authorities in a messaging group. Furthermore, the Federal Police indicates that the plan also involved other Army officers, all linked to the coup movement. In a recent decision, Moraes rejected the defense's request to replace Oliveira's preventive detention with precautionary measures, keeping him in custody until the full trial of the case.
