247 - Brazilian Supreme Court Justice Alexandre de Moraes has ordered that journalist Paulo Figueiredo be summoned in the United States via a letter rogatory—a formal request for cooperation between judicial authorities in different countries. The aim is to ensure that he can present his defense in the case investigating his alleged participation in an attempted coup d'état in Brazil.

Paulo Figueiredo has lived in the United States for about ten years. Given the impossibility of direct notification by the Brazilian justice system, according to... UOLMoraes decided to resort to the international instrument to ensure that the journalist is officially notified and complies with the established procedural deadlines.

International cooperation to guarantee defense

The letter rogatory will be sent to the US authorities in order to formally summon Figueiredo. After being notified, he must present his preliminary defense. Following this, the ministers of the First Panel of the Supreme Federal Court will decide whether or not to accept the charges filed against the journalist. If accepted, he will become a defendant and will be part of the so-called "fifth group" of the coup plot.

Letter rogatory

A letter rogatory is a mechanism provided for in international law that allows cooperation between countries in judicial proceedings. Through this instrument, Brazil requests that another country perform certain procedural acts on its behalf—such as serving summonses, hearing witnesses, or collecting evidence—when the person involved is outside the national territory.

With this decision, Alexandre de Moraes reaffirms the Supreme Federal Court's commitment to upholding procedural rules and the right to defense for all those under investigation. The minister has reiterated that the objective of these measures is to ensure transparency and legality in the investigations into the coup attempts of January 8, 2023, and the attacks against Brazilian institutions and democracy.
