Moraes schedules removal of Mauro Cid's ankle monitor for Monday.
Former aide to Jair Bolsonaro, convicted for participating in a coup plot, may be released from electronic monitoring following a Supreme Court decision.
247 - Brazilian Supreme Court Justice Alexandre de Moraes has scheduled for next Monday (3) the analysis of the request to remove the electronic ankle bracelet from Mauro Cid, former aide to then-President Jair Bolsonaro (PL). The decision could determine the end of the precautionary measures imposed since his plea bargain.
According to the UOLMoraes requested that the "period during which the defendant remained in pretrial detention be verified for the purposes of sentence reduction." Cid's defense argues that the time already served in pretrial detention and under restrictions would be sufficient to extinguish the sentence.
Defense requests the termination of precautionary measures.
Arrested in 2023 and released after signing a plea bargain with the Federal Police, Cid remains under electronic monitoring and nightly house arrest. His lawyers argue that these measures are no longer necessary, as there is no risk of interference in the investigations.
"These are exceptional measures, applicable only in situations that compromise the investigation, procedural instruction, or application of criminal law, which are currently nonexistent. The procedure is not unknown; however, reasonableness, which is also a guiding principle in judicial decisions, must be taken into account," the lawyers stated, according to the report.
Moraes had already denied a previous request.
In September, Moraes rejected a similar appeal, highlighting that the analysis of the sentence's fulfillment should only occur after the final judgment of the criminal case. However, the defense insists on a review of the precautionary measures, arguing that the excessive restrictions violate the principle of reasonableness.
Publication of the judgment confirms the conviction.
On October 22nd, the Brazilian Supreme Court (STF) published the judgment of the central group involved in the coup plot, which includes Mauro Cid among those convicted. The document contains the votes of the five justices of the First Panel and marks the final phase before the execution of the sentences.
In September, Cid was sentenced to two years in prison under a closed regime for the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup d'état, aggravated damage through violence and serious threat, as well as deterioration of listed heritage.
