TCU minister denies request from prosecutor who is a fan of Moro to participate in the case.

Conjur - Minister Bruno Dantas, of the Federal Court of Accounts, denied the request of the prosecutor of the Public Prosecutor's Office of Accounts, Júlio Marcelo de Oliveira, to participate as custos legis in the process that investigates Sergio Moro's relationship with the consulting firm Alvarez & Marsal.

The prosecutor filed a complaint with Minister Bruno Dantas, the case's rapporteur, questioning the actions of Deputy Attorney General Lucas Furtado, from the Public Prosecutor's Office at the TCU (Federal Court of Accounts), in the case, and alleging that the authority to act in the proceedings against Moro rests with him.

In his decision, Dantas recalled that he had already stated that he would consider the request for intervention as custos legis when appropriate, in light of elements that might indicate a public interest justifying it.

But Júlio Marcelo de Oliveira filed a second petition, even though his previous request had not yet been considered. Therefore, the minister called the prosecutor's attention to the fact that he was trying to obstruct the work of the TCU (Federal Court of Accounts) and cause procedural disruption in a process that "does not even remotely justify the involvement of two members of the MPTCU (Federal Public Prosecutor's Office of the Federal Court of Accounts)."

The minister also pointed out that the reasons given by Marcelo are insufficient to satisfy the legal requirements that would justify the intervention of custos legis. "I emphasize that personal sympathy or ideological convergence should not be confused with public interest," he concluded.

A staunch supporter of the defunct "Lava Jato" operation, Oliveira has a collection of posts praising the former judge, now a politician. In one, he posted a photograph of himself alongside Moro; in another, he poses next to former prosecutor Deltan Dallagnol. In 2016, Oliveira became involved in the campaign in favor of the "10 measures against corruption," one of the main banners of Lava Jato.

On Twitter, he called Moro an "example of a magistrate and public figure" and said that the former judge "deserves all the honors." When Moro left the Ministry of Justice, he stated on the same social network that the now officially politician is "a giant who has always put himself at the service of Brazil."
