Lindbergh and Randolfe ask the Supreme Court to arrest Eduardo Bolsonaro for military crime.
In addition to the crimes cited by the Attorney General's Office, Eduardo is accused of attempting to incite conflict with the US, which constitutes a military crime, according to members of the Workers' Party.
247 - The leaders of the PT in the Chamber of Deputies and of the Lula (PT) government in the National Congress, Lindbergh Farias (PT-RJ) and Randolfe Rodrigues (PT-AP), respectively, filed a criminal complaint this week with the Supreme Federal Court (STF) requesting the preventive detention of the licensed federal deputy Eduardo Bolsonaro (PL-SP).
According to Lauro Jardim, from the newspaper The GlobeIn the petition addressed to Minister Alexandre de Moraes, the parliamentarians accuse Eduardo of coercion during the course of the process, obstruction of justice, and an attack on national sovereignty. According to them, Jair Bolsonaro's (PL) son allegedly acted in US territory to encourage the application of economic sanctions against Brazilian authorities and the country itself, with the aim of retaliating against decisions of the Supreme Federal Court (STF) and the Attorney General's Office (PGR).
The signatories also point to the possible commission of a military crime, based on article 141 of the Military Penal Code, which deals with "an understanding with a foreign country to generate conflict or divergence with Brazil." They assert that this conduct would fall under the jurisdiction of the Supreme Federal Court (STF) because it involves an agent with privileged jurisdiction. "It should be noted that, in addition to the crimes indicated by the Attorney General's Office (PGR), the crime of 'Understanding to generate conflict or divergence with Brazil' is considered applicable to the case [...]. The content of the note signed by Eduardo Bolsonaro and the consequent announcement of sanctions by the United States government reveal a clear attempt to generate conflict or divergence of an international nature between Brazil and that country," the document states.
The Workers' Party's initiative is based on documents, official notes, and public statements that, according to them, demonstrate Eduardo's direct involvement in pressuring the United States government to impose sanctions. These sanctions were allegedly justified under the argument of "defending threatened freedoms and denouncing alleged abuses committed by the Supreme Federal Court."
Brazilian lawmakers hold Eduardo Bolsonaro responsible for the so-called "tariff hike" imposed by President Donald Trump's administration, which he and blogger Paulo Figueiredo celebrated. According to Lindbergh and Randolfe, this constitutes an act of treason against the nation, as it instrumentalized a foreign government against sovereign decisions of the Brazilian judiciary, with negative impacts on the national economy and threats to members of the Supreme Court and the Attorney General's Office.
The petition further states that Jair Bolsonaro confessed to financing Eduardo's activities in the US with funds raised via Pix (Brazil's instant payment system), exceeding R$ 2 million. According to the authors of the action, this could constitute the existence of a deliberate financing structure to disrupt criminal jurisdiction and interfere in ongoing investigative processes.
In addition to the preventive detention, the parliamentarians are requesting that Moraes send the case files to the Attorney General's Office for a statement from the Attorney General, Paulo Gonet, regarding a possible criminal indictment or amendment to the existing indictment against Eduardo Bolsonaro.
If the arrest warrant is not granted, the document requests that precautionary measures be applied, such as the suspension of the diplomatic passport, prohibition of leaving the country, prohibition of contact with foreign authorities or agents, and the freezing of assets, in order to prevent the risk of concealment of assets.
