Court suspends annulment of 13 questions on the ENEM exam.
The appeal from the Ministry of Education was granted by Judge Paulo Roberto de Oliveira Lima; the exams remain fully valid for all candidates, except for students of Colégio Christus; the Federal Public Prosecutor's Office of Ceará may still appeal.
247 - The Federal Regional Court of the 5th Region accepted an appeal from the Ministry of Education and suspended the annulment of 13 questions from the 2011 National High School Exam. Now, the items will only not be valid for the 639 students of Colégio Christus in Fortaleza. The decision was made by Judge Paulo Roberto de Oliveira Lima. According to him, the solution of maintaining the exam for the entire country, including Ceará, only recalculating the tests for the Christus students, is the most reasonable. Therefore, the 13 questions will only be invalidated for the candidates from that school.
“The injunction in question affects the interests of approximately 5 million students, extending its effects to their admission to various public universities across the country, impacting the granting of scholarships, the obtaining of funding, and the direction of public policies. The matter is serious and does indeed influence the organization of the administration,” wrote the judge. The Federal Public Prosecutor's Office of Ceará can still appeal the decision.
Understand the case
Yesterday afternoon, the Attorney General's Office (AGU) filed an appeal against the Federal Court's decision to annul the 13 leaked questions from the ENEM exam. The AGU represents the interests of the National Institute for Educational Studies and Research Anísio Teixeira (Inep), the arm of the Ministry of Education responsible for the exams.
The more than four million candidates who took the ENEM exam still have more doubts about the validity of the tests than about the questions they answered on October 22nd and 23rd. The Federal Public Prosecutor's Office questioned the exam due to the leak of 13 questions in Fortaleza. Federal prosecutor Oscar Costa Filho recommended that these items be annulled or that the tests of all candidates be cancelled. The Federal Court in Ceará accepted the request and decided to cancel only those questions.
The Ministry of Education, however, contested this annulment, attributing the leak to the ENEM pre-test phase at Colégio Christus, in the capital of Ceará. The MEC had already only ordered the cancellation of the exams for the 639 students from the institution. However, both the Public Prosecutor's Office and the Federal Court in Ceará understood that the leaked questions may have been shared not only among these students, but also with their friends and other candidates throughout the country.
