A court in Brasília rejects domestic violence charges against Bolsonaro-supporting congressman Zé Trovão.

The congressman had been denounced by his ex-wife in 2023, following a disagreement inside the apartment where they lived.

247 - The 3rd Criminal Chamber of the Court of Justice of the Federal District and Territories (TJDFT) decided, this Friday (February 28th), to uphold the first instance ruling and reject the domestic violence charges against the Bolsonaro-supporting federal deputy Zé Trovão (PL-SC). According to the MetropolisThe Court determined that there is neither materiality nor just cause to proceed with the case.

The congressman had been denounced by his ex-wife in 2023, after a disagreement inside the apartment where they lived. According to the victim's account, Zé Trovão pushed her during the argument and said: "I'm going to finish you off." The congressman, in turn, stated that it was his ex-partner who initiated the aggression and that he only defended himself by pushing her.

Judge Cruz Macedo, the rapporteur for the appeal, argued that there was insufficient evidence to justify opening a criminal case. "It is clear from the testimonies that there is no minimum evidentiary basis necessary for initiating criminal proceedings (proof of the crime and evidence of authorship), which serves as a safeguard against the abusive use of the right to accuse. Therefore, given the principle of minimal state intervention, this does not warrant further proceedings in this judicial sphere," he wrote.

The judge also considered the statements attributed to both during the disagreement. According to him, the expression "I'm going to finish you off," allegedly said by the congressman, and the phrase "I'm going to f*ck up your life," which was supposedly said by his ex-wife, "do not resonate as possible intimidation and coercion of one against the other, or as an act that would cause unjust and serious harm."

The rapporteur's decision was supported by the other judges of the 3rd Criminal Chamber, thus concluding the case in the judicial sphere.
