Legal experts ask Dodge for clarification regarding the Lava Jato foundation.

The petition from the Brazilian Association of Jurists for Democracy (ABJD) and the Association of Judges for Democracy (AJD) raises 14 questions, such as "what concessions did Brazil offer the United States in exchange for 80% of the fines for crimes committed in that country being transferred to us?" and "what is the legal basis for the deposit of this amount with the 13th Federal Court of Curitiba?"

247 - The Brazilian Association of Jurists for Democracy (ABJD) and the Association of Judges for Democracy (AJD) filed a document this Wednesday (13) with the Attorney General's Office (PGR) requesting clarifications about the agreement signed between Petrobras and the Federal Public Prosecutor's Office (MPF) for the creation of a foundation to be managed by those responsible for Lava Jato. In exchange for the R$ 2,5 billion that will be delivered by the state-owned company to the foundation, the company will transfer confidential commercial information and its patents to the United States government.

The associations' request is addressed to the Attorney General of the Republic, Raquel Dodge, in her capacity as head of the Federal Public Prosecutor's Office (MPF). The document raises 14 questions, such as "what concessions did Brazil offer the United States in exchange for 80% of the fines for crimes committed in that country being transferred to us?" and "what is the legal basis for the deposit of this amount with the 13th Federal Court of Curitiba?".

According to Judge Laura Benda, president of AJD, requesting clarification on the actions of public officials is a prerogative of any person or entity in civil society. The associations' request is "in observance of the principles of public morality, transparency, and also the very specific definitions of the duties of the agency itself," states the magistrate.

On Tuesday (12), the Public Prosecutor's Office announced the suspension of the creation of the private foundation managed by Lava Jato. For Carol Proner, from ABJD, it is not enough to backtrack on the creation of the foundation, there are still many unanswered questions. “They backed down, but they don't explain anything about the agreement with the US and Petrobras. It is the duty of the body to clarify these issues well, based on the law on access to information.”
