A neighbor who complained about the noise made by a couple during sex was ordered to pay R$ 5.100 to each of them in damages for moral harm. The defendant was sued for the complaint he made in the condominium's logbook in Rio de Janeiro. He said that the couple's behavior would only be acceptable in "brothels and roadside motels." The neighbor reported that the couple went from indiscreet moans to scandalous screams.
In his decision, Judge Sergio Jerônimo Abreu de Silveira, of the 4th Civil Chamber of the Court of Justice of Rio de Janeiro (TJ-RJ), considered that there had been an excess on the part of the defendant. According to the judge, the way the couple's privacy was exposed tarnished their image in the eyes of other residents of the building.
