Fachin cancels meeting to discuss the Supreme Court's Code of Ethics.

247 - The president of the Supreme Federal Court (STF), Edson Fachin, decided to cancel the meeting scheduled for February 12th, which would have as its main agenda the discussion of the Court's new Code of Ethics. The cancellation also affected the lunch that would have marked the first informal meeting between the Supreme Court justices under Fachin's leadership. The decision was communicated internally and caught part of the court by surprise, since the Code of Ethics had been presented as one of the priorities of the new STF presidency.

Internal resistance and risk of deflation.

Behind the scenes, the retreat is linked to doubts about the quorum for the meeting. The proposal to create a Code of Ethics generated resistance among ministers, some of whom even considered not attending the meeting. Since attendance at this type of meeting is not mandatory, the absence of members of the board would be interpreted as a political undermining of the initiative. 

Faced with the possibility of a meeting with low turnout, Fachin opted to postpone the debate, avoiding friction so early in his tenure as head of the Supreme Court. Contacted for an explanation regarding the reasons for the cancellation, the STF presidency did not respond to the reporter's questions. 

Code of ethics is Fachin's main focus.

The discussion about the Code of Ethics is directly linked to the defense of the so-called "self-correction" of the court. At the opening of the judicial year, Fachin stated that the Supreme Federal Court (STF) has come to occupy a central space in the decisions of the Brazilian State and that it would be necessary to seek greater institutional balance.

The proposed new code, with Justice Cármen Lúcia as rapporteur, was presented as an instrument to establish standards of conduct and contribute to restoring public confidence in the Court.

Disagreements expose the difficulty of reaching a consensus in the Supreme Court.

Despite this, the issue divides the court. One wing of the Supreme Court, led by Justice Gilmar Mendes, had already expressed discomfort with the initiative, seen as a possible "stifling" of the magistrates' actions.
