Dino reinstates CFM resolution prohibiting hormone therapy in transgender children and adolescents.

The Supreme Court will still decide on the validity of the CFM resolution.

247 - Brazilian Supreme Court (STF) Justice Flávio Dino suspended a preliminary injunction from the Federal Court of Acre that had suspended the effectiveness of a rule by the Federal Council of Medicine (CFM) for the use of hormone therapy in transgender children and adolescents, the Court said in a statement on Tuesday (7). 

With this, the CFM (Brazilian Federal Council of Medicine) rule was reinstated, stipulating that hormone treatment for gender transition can only begin at age 18. The rule also restricts the use of hormone blockers to specific clinical situations, such as precocious puberty.

Last week, Dino decided that it is up to the Court to analyze whether the CFM's resolution on transgender youth is illegal. With this, the STF suspended the decision of the Federal Court of Acre. The decision had already validated the CFM's rule until a final judgment is reached. 

Dino stated on Tuesday that it will be up to the Supreme Court to decide on the validity of the resolution. According to him, the first instance decision encroached upon the Court's jurisdiction and "fragmented constitutional jurisdiction."
