The defense filed a request to prevent Marcos do Val's arrest upon arrival in the country.
The senator returned from the US without authorization from the Supreme Court and began wearing an ankle monitor by order of Alexandre de Moraes.
247 - Brazilian Supreme Court Justice Cristiano Zanin rejected a request from the defense of Senator Marcos do Val (Podemos-ES) seeking to prevent the senator's potential arrest upon his return to Brazil. The decision was made on procedural grounds and was confidential.
Marcos do Val landed this Monday morning (4) at Brasília airport after spending about ten days in Orlando, in the United States, even without authorization from the Supreme Court to make the trip. As soon as he arrived in the country, he was approached by Federal Police (PF) agents to comply with precautionary measures imposed by Minister Alexandre de Moraes.
In practice, the senator's lawyers were seeking a kind of safe-conduct to protect him from possible detention for violating a previous Supreme Court decision that had denied his request to leave the country. However, Zanin understood that there were no concrete elements to justify the defense's fear. "I note, initially, that the decision is under seal and, for this reason, it is not possible to gather elements that indicate the risk of imprisonment claimed by the defense," the minister stated in the decision.
Moraes' order, which was carried out as soon as the senator set foot on Brazilian soil, includes the mandatory use of an electronic ankle monitor and a series of restrictions. Among them are nightly house arrest from 19 pm to 6 am during the week, and full house arrest on weekends, holidays, and days off.
Other precautionary measures ordered by Moraes include:
- Cancellation and return of diplomatic passport;
- Prohibition of the use of social media, directly or indirectly;
- Freezing of assets, bank accounts, investments, vehicles, and wages;
- Suspension of all PIX keys and cards linked to the senator.
Marcos do Val is under investigation in two inquiries at the Supreme Court. One of them investigates his alleged attempt to interfere in the 2022 elections to annul the presidential result. The other investigates attacks and offenses directed at investigators of the Federal Police.
