Valério's defense appeals to the Supreme Court to use frozen funds.

247 - Lawyer Marcelo Leonardo sent an appeal to the Supreme Federal Court last Friday (20) so that advertising executive Marcos Valério, convicted in Criminal Action 470, can use funds blocked by the Justice system to pay the R$ 4,4 million fine imposed on him.

The first time the request was made, the president of the Supreme Federal Court (STF), Joaquim Barbosa, decided, on the 12th of last month, that the blocked funds could not be used to pay fines.

According to Barbosa, since Valério was convicted without the possibility of appeal for several crimes, including corruption, it was demonstrated that he obtained his assets through criminal activity. Therefore, the president ruled that the money could not be used to benefit the convicted individual. The minister also emphasized that the assets obtained by Marcos Valério from 2003 onwards should be auctioned off and the proceeds returned to the public treasury.

Since the decision was made by Barbosa individually, Marcelo Leonardo filed an appeal known as a motion for reconsideration. In practice, Barbosa's decision will be submitted to the full Supreme Court, which can uphold or overturn it. Barbosa stepped down from presiding over the Mensalão case and was replaced by Luís Roberto Barroso.
