Lula's defense team requests that the case regarding the country house be moved from Curitiba.

Former President Lula's defense team has filed a request with the Supreme Federal Court (STF) to have the case concerning the Atibaia property, which resulted in the former president's conviction without evidence and a 12-year and 11-month prison sentence, removed from the 13th Federal Court of Curitiba and sent to the Federal Court of Brasília. With this action, the lawyers hope that Judge Gabriela Hardt's decision will be overturned.

247 - The defense team for former president Luiz Inácio Lula da Silva has filed a request with the Supreme Federal Court (STF) to have the case concerning the Atibaia property, which resulted in the former president's conviction without evidence and a sentence of 12 years and 11 months in prison, removed from the 13th Federal Court of Curitiba and sent to the Federal Court of Brasília. With this action, the lawyers hope that Judge Gabriela Hardt's decision will be overturned.

The request, which is under the purview of STF minister Cármen Lúcia, was made by the defense on Wednesday morning (6), a few hours before the publication of the conviction sentence. However, she has not yet made a decision. Previous requests to remove the case from the jurisdiction of the 13th Federal Court of Curitiba, however, have already been denied by ministers Dias Toffoli, who before assuming the presidency of the STF was the rapporteur of the case in the Court.

In the request, the defense argues that the case should not remain in Curitiba since the Second Panel of the Supreme Federal Court (STF) had decided, in April of last year, to remove the terms of the collaboration agreements related to the investigation into the Atibaia property from the 13th Federal Court. When rejecting the preliminary injunction last year, Toffoli ordered the removal of mentions of Lula made by Odebrecht whistleblowers regarding the case.
