In the petition submitted to Minister Alexandre de Moraes, the case's rapporteur, the defense states that the former president is facing a fragile state of health, which has worsened in recent days. The lawyers argue that the clinical situation reinforces the need for a swift analysis of the request for house arrest.

"Therefore, considering the expiration of the deadline set by Your Excellency, and the already widely outlined fragile state of health of the Petitioner — which, moreover, has worsened in recent days, with the onset of emetic episodes and a pronounced bout of hiccups — it is requested that the Superintendence of the Federal Police, in the person of its responsible party, be ordered to proceed, with the utmost urgency, with the inclusion of the expert report in the case file," says an excerpt from the petition.

Medical expert from the Federal Police remains absent from the process.

The medical examination was conducted on January 20th by professionals from the Technical-Scientific Directorate of the Federal Police, following a directive from Minister Alexandre de Moraes. The evaluation was defined as a preliminary step to the re-evaluation of the need to grant humanitarian house arrest.

Despite this, the expert report was not attached to the case file, even after the ten-day deadline stipulated by the rapporteur had expired. According to the defense, the absence of the document prevents the technical expert appointed by the lawyers from providing their opinion and blocks the progress of the analysis of the request.

In the petition, the lawyers request that the Federal Police Superintendency in Brasília be ordered to urgently submit the expert report. The objective is to enable the presentation of a supplementary technical opinion and allow the Supreme Federal Court to assess the necessity of the humanitarian measure.

Legal situation of the former president

Bolsonaro has been imprisoned since January 15th at the 19th Battalion of the Military Police of the Federal District, known as Papudinha. He was sentenced to 27 years in prison for attempting a coup d'état after the 2022 elections.
