DCM: STJ hid from Lula's defense that the appeal would be judged this Tuesday.

Journalist Joaquim de Carvalho believes that the appeal hearing for Lula before the Fifth Panel of the Superior Court of Justice (STJ) could be annulled because the Court failed to inform Lula's defense team. "At 18:20 PM, a lawyer representing Lula in the case contacted the office of Minister Felix Fischer to inquire whether the hearing was scheduled. The response was negative, but at 20:19 PM, the court's press office informed that the hearing would be held today, despite there being no scheduling in the STJ's electronic system," says Carvalho.

247 - Journalist Joaquim de Carvalho, from Diário do Centro do Mundo, believes that the appeal hearing of former president Luiz Inácio Lula da Silva by the Fifth Panel of the Superior Court of Justice (STJ) could be annulled because the Court failed to inform Lula's defense. 

"At 18:20 PM, a lawyer representing the case sought out the office of Minister Felix Fischer to inquire whether the hearing was scheduled. The response was negative, but at 20:19 PM, the court's press office informed that the hearing would be held today, despite there being no scheduling in the STJ's electronic system," says Carvalho. 

"It may seem like childishness, but it's much more serious than that: the Superior Court of Justice (STJ) has been hindering Lula's right to a full defense. Last year, Félix Fischer had already rejected Lula's appeal in a monocratic decision, also taken by surprise. Normally, in cases like this, the decision is not monocratic, and the parties are notified in advance so that they can make their oral arguments. Fischer, however, decided alone that Lula's conviction by Judge Sergio Moro was legal, despite there being no evidence of a crime or description of criminal conduct in the case," says the journalist.
