In a hurry, Fux sees the end of AP 470 on September 7th.
Hinting that he already considers the appeals for clarification nonexistent, Luiz Fux aligns himself with the agenda set by Merval Pereira of the newspaper O Globo, who believes everything should be resolved before Independence Day, and estimates that the trial of Criminal Action 470, the so-called 'mensalão' scandal, will conclude on September 7th; lawyers for the defendants believe that debates should continue for longer; the minister also considers the tension between Joaquim Barbosa and Ricardo Lewandowski to be "overcome".
247 – Despite the impasse regarding whether or not the Supreme Federal Court will accept the appeals for clarification, Minister Luiz Fux believes that the final judgment in the case of Criminal Action 470 will be on September 7th. According to him, who spoke to Folha de S.Paulo this Monday the 19th, the sentences of the defendants will be known "by September 7th at the latest". Analysts believe, however, that if the appeal is accepted, the trial should not end until the end of this year.
The second phase of the so-called 'mensalão' trial began last Wednesday, when the justices started analyzing the declaratory appeals – presented when there is some doubt, contradiction, or obscure fact in the judges' decisions. Regarding the dissenting opinions, the court is divided on whether or not they should be accepted, since they are not included in Law 8.038 of 1990, only in the Supreme Court's internal regulations.
By setting the final date as September 7th, Fux is therefore already considering the appeals for clarification nonexistent and is following the agenda suggested by columnist Merval Pereira of the newspaper O Globo, who states that the Supreme Court justices should take into account "the large demonstrations being called throughout the country to celebrate Independence Day from the perspective of citizenship" before voting on the appeal (read more). hereFor him, everything must be resolved before the holiday.
Crisis "overcome"
Minister Luiz Fux also stated that the tension created after a heated exchange between the president of the Supreme Federal Court (STF), Joaquim Barbosa, and Minister Ricardo Lewandowski, "has been overcome," and that the trial should resume normally in Wednesday's session. "I'm going to Brasília now and I'm sure everything is back to normal, we will resume the trial normally on Wednesday," he said. Fux also said he believes the episode should not change anything in the trial.
