247 - The Attorney General's Office (AGU) issued an opinion, published in the Official Gazette of the Union (DOU) this Wednesday (12), which prohibits the participation of individuals and companies involved in the terrorist acts of January 8, when Bolsonaro and far-right militants invaded and vandalized the headquarters of the Three Powers, in Brasília, in tenders and contracts with the federal public administration.
According to the Attorney General's Office (AGU), the hiring of individuals and legal entities involved in the coup attempt is incompatible with the principles of morality, public interest, and legal certainty enshrined in the Constitution. The opinion emphasizes that "the practice of developing, or even encouraging, actions that undermine the Powers of the Republic constitutes a violation of the Democratic Rule of Law and the 'republican' principle, both values that underpin the Legal Order established by the 1988 Federal Constitution, thus constituting, in light of this, conduct highly reprehensible under the national legal system."
The administrative process regarding this case will be initiated by the federal government, responsible for actions to repair damage to public assets, within a period of five years. The disqualification period varies from three to six years.
Although the "declaration of ineligibility" made by the Attorney General's Office does not result in the immediate termination of ongoing contracts, their extension will be prevented by the current Bidding Law, dated 2021.
