Damares participated in a public hearing at the Senate Human Rights Commission to discuss the actions of her ministry.
"This is a matter for the National Congress, and I will say it: it belongs to the National Congress, not the Judiciary. This issue cannot be discussed in the Judiciary," Damares stated.
The statement was made in response to a question about a case before the Supreme Federal Court (STF) that calls for the legalization of abortion in cases of Zika.
She criticized what she called the "activism" of the Judiciary in dealing with issues that, in her view, fall under the purview of the Legislative branch, as it was elected by the people.
