247 - At the opening of the trial of Jair Bolsonaro (PL) and seven other defendants from the so-called "crucial core" of the attempted coup d'état, this Tuesday (2), Minister Alexandre de Moraes made a harsh speech in defense of Brazilian democracy. In a firm tone, the magistrate stated that national sovereignty "cannot, must not and will never be vilified, negotiated or extorted", in reference to external pressures attributed to the current president of the United States, Donald Trump.
Moraes also denounced the actions of a "true criminal organization" that, according to him, sought to intimidate Brazilian authorities and even subject the functioning of the Supreme Federal Court (STF) to foreign interests. The minister highlighted that this structure was allegedly led by Congressman Eduardo Bolsonaro (PL-SP), son of the former president.
The Brazilian Supreme Court reaffirms its constitutional mission.
Moraes recalled that Brazil is entering 2025 with almost four decades of redemocratization and a Constitution that, even amidst crises, has sustained institutional stability. "A democratic rule of law does not mean the absence of conflict, but rather respect for the Constitution, the application of the law, with absolute respect for due process, the right to a full defense, and the right to a fair hearing," he stated.
He stressed that the ongoing trial is just another example of the Supreme Court's role as guardian of the Constitution. "Just as with the 1.630 criminal cases filed by the Attorney General's Office as of January 8, 2023 — which resulted in 683 convictions, 11 acquittals, 554 non-prosecution agreements, and 382 still pending — this Court will continue to judge with impartiality and technical rigor," he declared.
Impunity and pacification
The minister stressed that national pacification cannot be confused with impunity. "History teaches us that impunity, omission, and cowardice are not options for pacification. The seemingly easier path leaves traumatic scars on society and corrodes democracy," he warned.
According to Moraes, the mission of the Supreme Federal Court (STF) is to ensure that each defendant is judged based on evidence. "If there is evidence beyond any reasonable doubt, the defendants will be convicted. If there is doubt or proof of innocence, they will be acquitted. That is how justice is done," he said.
Defending sovereignty and sending an international message.
In the most forceful part of his speech, Moraes emphasized that the independence of the Judiciary is a fundamental right of all citizens and that the Supreme Federal Court (STF) will never accept external interference. "National sovereignty cannot, must not, and will never be violated, negotiated, or extorted, as it is one of the foundations of the Federative Republic of Brazil, enshrined in the Constitution. This Court will always be absolutely inflexible in defending national sovereignty, democracy, and the independence of the Judiciary," he stated.
In a direct message to Trump, Moraes reinforced that the Supreme Court will not bow to international pressure. "The history of this Supreme Court demonstrates that its members have never lacked, nor will they ever lack, the courage to repudiate attacks against national sovereignty, democracy, the rule of law, or the independence of the judiciary. This Court has been and will continue to fulfill its constitutional mission," he concluded.
