Devastating vote

Look, it will be very difficult to contest any line of Alexandre de Moraes' brilliant and devastating opinion, which cleared up any remaining doubts in clear and good Portuguese, starting with the controversy surrounding punishment for two very similar articles, 359 M and 359 L. He explained very clearly that 359 M refers to attempting a coup d'état from within the government itself, which is what Bolsonaro did during his term, violently attacking the Supreme Court; while 359 L refers to overthrowing an already elected government, which is what Bolsonaro attempted after Lula's victory, the outcome of which was the 8/1 defeat. These are two different articles, two crimes, and two punishments.

Moraes began by saying that the trial was not about an attempted coup – even the defense agrees on this point – but rather about authorship, linking the events since July 2021, all carried out with the aim of perpetuating the group – the criminal organization – in power. Led by Jair Messias Bolsonaro. He repeated this several times. The President of the Republic headed the criminal organization.

He presented the chronology of the coup, in 13 extensively documented episodes, both of the coup d'état (against the Supreme Court) and the abolition of the rule of law (preventing Lula's government), in which he framed the accused, revealing the role of each one in the plot, without sparing anyone, not even those who in recent days had been pointed out as "less" guilty, such as Generals Augusto Heleno and Paulo Sérgio. It was also very clearly demonstrated that Bolsonaro, the leader of the criminal organization, commanded the attempted insurrection with his speeches threatening the ministers of the Supreme Federal Court (STF), instructing his ministers to denounce a non-existent weakness in the ballot boxes, convening the meeting with the ambassadors, altering the content of the coup draft, receiving the Green and Yellow Dagger plan, and attempting to co-opt the military chiefs. All initiatives originated from him, always seconded by Braga Netto.

Fux already hinted in today's session that he's very keen to spoil Moraes's party during his vote tomorrow at 9:00 AM, but he'll have to do a lot of legal acrobatics to counter the rapporteur's masterclass.
