Bill championed by Tarcísio grants amnesty to Bolsonaro, PCC, criminal organizations, and militias.

Bolsonaro's proposed legislation paves the way for impunity by including even criminal factions and militias in the amnesty.

“We want a broad, general, and unrestricted amnesty,” proclaimed Tarcísio de Freitas on Avenida Paulista, now stripped of his moderate technocrat disguise and dressed in the truculent, Bolsonaro-supporting attire.

The draft of the Bolsonaro-backed bill grants such unrestricted amnesty that it even benefits criminal organizations and, including, militias! Yes, militias! The Bolsonaro-backed bill states that, in addition to the coup plotters, members of "criminal organizations, criminal associations, or [those who participate in] the formation of private militias" will also be granted amnesty.

It is clear that we are facing an illegal political movement, because it is criminal. A movement of a fascist nature, organically linked to the underworld of organized crime.

The despicable proposal for amnesty for the coup plotters and traitors of the Nation could never be submitted to Congress. It resembles another project written in the style of the PCC – the untouchable and unaccountable amendment, only aborted due to the resounding public outcry.

It is clear that we are threatened by a fascist force-movement that bets on chaos, debacle, hybrid warfare, etc., as a power strategy of the criminal underworld that plunders the spoils of a homeland they want to hand over to Trump.

Popular outrage on social media and directed at parliamentarians brought down repugnant legislative proposals, such as the "rapist bill" and, as mentioned above, the "untouchable mobster" amendment.

The defeat of the amnesty proposed by the fascists is another decisive battle in the tenacious and ongoing struggle to crush fascism.

And let's face it: between democracy and crime, the vast majority of the people know the value of democracy, however imperfect it may be.

Full text of Bolsonaro's amnesty proposal:

"BILL NO. , OF , OF 202_"
Grants amnesty and provides other measures.

The National Congress decrees:
Article 1. Amnesty is granted to all those who, in the period between March 14, 2019 and the date this Law comes into force, have been or are being, or may eventually be, investigated, prosecuted or convicted for conduct such as:

I – that constitute verbal or written statements, including those made in public places, on internet pages, social networks, public bodies, media outlets or any other channels, that have been or may be considered as:
a) offense or attack against public institutions or their members;
b) discrediting the electoral process or the Powers of the Republic;
c) reinforcement of political polarization;
d) generating animosity in Brazilian society; or
e) situations of a similar nature to the previous ones;

II – classified as a crime in Title XII of Decree-Law No. 2.868, of December 7, 1940 – Penal Code;

III – associated, in any way, with those mentioned in items I and II, including:
a) the provision of administrative, logistical or financial support, as well as any other form of contribution, stimulus or incentive; or
b) damage to federal property, deterioration of listed property, incitement to crime, glorification of crime or criminals, criminal organization, criminal association, or formation of a private militia;

IV – determined:
a) in investigations initiated based on article 43 of the Internal Regulations of the Supreme Federal Court; or
b) with the support of information, news or reports produced with the collaboration of the Special Advisory Office for Combating Disinformation of the Superior Electoral Court or a body within the Electoral Justice system that performs or has performed similar functions;

V – considered as manifestations aimed at producing or disseminating misinformation or false data regarding parties, candidates, governments, elections, or political agents.

§ 1. The amnesty referred to in this Law automatically removes any effects of the criminal conviction, as well as determines the dismissal of ongoing inquiries, investigations and criminal proceedings.

§ 2. The amnesty also covers:
I – the effects arising from precautionary and preliminary injunctions in force, fines and compensation, including for moral damages, as well as any restrictions on rights imposed, judicially or administratively, due to the conduct referred to in the heading;
II – procedures to be initiated with the objective of holding individuals accountable for conduct committed during the period referred to in the heading, provided that such conduct falls within the scope of this Law;
III – civil, administrative and electoral offenses linked to or associated with the conduct referred to in the heading, including all ineligibilities already declared or that may be declared by the Electoral Court against the beneficiaries of this Law;
IV – political or related crimes, electoral crimes, and those in which social and political rights have been violated.

§ 3. For the purposes of item I of the main clause, the concept of street demonstrations also includes movements and encampments that occurred in front of buildings, headquarters, and facilities administered by military institutions, as well as the protests that occurred in the federal capital on January 8, 2023.
