Either Nuzman is granted habeas corpus or Article 5 is revoked.
"The three provisions of Article 5 of the 88 Constitution were once again ignored, this time on the occasion of the arrest of Carlos Arthur Nuzman, the man who brought the Olympics to Brazil last year, this morning. His honor and image were violated by the media exposure of his capture by the police. He was deprived of his liberty before the conclusion of due legal process, which has barely begun," denounces journalist Alex Solnik; "The justice of vengeance cannot be admitted if the constitution has not been revoked or replaced by another," he argues; for him, "the Supreme Court, whose primary mission is to protect the rights of individuals affected by state brutality, has every legal reason to grant him habeas corpus."
"The intimacy, private life, honor, and image of individuals are inviolable, and the right to compensation for material or moral damages resulting from their violation is guaranteed."
"No one shall be deprived of liberty or property without due process of law."
"No one shall be considered guilty until a final and unappealable criminal conviction is issued."
These three provisions of Article 5 of the 88 Constitution were once again ignored, this time on the occasion of the arrest this morning of Carlos Arthur Nuzman, the man who brought the Olympics to Brazil last year.
His honor and image were violated by the media's exposure of his capture by the police.
He was deprived of his freedom before the conclusion of due legal process, which had barely begun.
The leak of accusations, which are partial and yet to be proven, likely originating from the Federal Police or the Judiciary, leads public opinion to consider him a criminal before a final and unappealable conviction has been handed down.
Without going into the merits of the offenses he is accused of, once again the Federal Police and the Judiciary are trampling on individual rights enshrined in the constitution in order to satisfy the punitive fury that has plagued the country since the start of Operation Lava Jato.
Revengeful justice cannot be accepted if the constitution has not been revoked or replaced by another.
Deprivation of liberty before a final and unappealable judgment has the same connotation as the imprisonments carried out during the 64 military regime, when guarantees and individual rights were suppressed.
Its hidden objective is to pressure the individual into confessing to the accusations made against them and denouncing potential partners as the only means of regaining freedom.
In other words, instead of investigation, intimidation takes center stage.
The Supreme Federal Court (STF), whose primary mission is to protect the rights of individuals affected by state abuse, has every legal reason to grant him habeas corpus.
Nuzman is not the first victim of vengeful justice. But it is always hoped that he will be the last.
