Nardes continues to carry out his duties normally at the TCU, despite the coup-mongering audio.

According to Law 8.112 of 1990, the case should already be under formal investigation.

Despite the audio distributed to Bolsonaro supporters and far-right activists predicting coup attempts, TCU (Federal Court of Accounts) minister Augusto Nardes continues to work normally at the Court, as if nothing had happened. The minister received a gross salary of R$ 81 in January and R$ 97 in February.

In the recording, leaked to the public on November 20, 2022, and acknowledged by him as authentic, Nardes stated that "a very strong movement is taking place in the barracks."

Here a parenthesis is in order: given the repercussions of the case, the minister adopted the well-known procedure for circumstances like this: he remained silent and went on medical leave from November 22, 2022 to December 16, 2022.

The TCU's Transparency Portal shows that during the period he was on medical leave, Nardes increased his paycheck by "only" R$ 2.448,07 in November and R$ 4.964,53 in December under the heading "Reimbursement for medical assistance".

It is noteworthy, however, that precisely during this period when he was on sick leave, there was a significant decrease in his reimbursements for medical expenses compared to the average amount he had been receiving in this category before going on leave.

In the previous six months, from May to October 2022, Nardes reimbursed R$ 42.950,92 in medical expenses alone, which corresponds to a monthly average of R$ 7.158,48 – almost triple the amount reimbursed in November, when he was ill.

Now that we've closed the parenthesis on this interesting fact, let's return to the audio.

Demonstrating knowledge of the facts and coup plots within the Army, which, according to him, would have a "very strong impact on the nation," Nardes assured that it would happen "in a matter of hours, days, at most a week, two, maybe less than that."

On that date, criminal hordes that emerged from the Army Headquarters headed towards the Esplanade and carried out the most audacious, barbaric, and violent attack on democracy and the powers of the Republic.

Consulted via the Access to Information Law on January 14, 2023, regarding the measures taken in relation to the case, the TCU (Brazilian Federal Court of Accounts) did not respond within the legal deadline. Due to the lack of response, the Ombudsman's Office responded by email on February 13, 2023: “The TCU informs that, through its Internal Affairs Office, it has been investigating the facts reported in complaint no. 356998”.

Despite stating that it is “investigating the facts”, the Court did not respond to the requests regarding [1] the type of process initiated [whether inquiry, investigation, disciplinary administrative process, etc.], [2] the process number, [3] the mechanism for monitoring the process and [4] the estimated time to conclude the investigation.

On February 24th, another request for information was made to the TCU (Brazilian Federal Court of Accounts) to supplement the responses that have not yet been provided.

The serious attacks of January 8th attest to the "accuracy" of Minister Nardes' predictions. They also demonstrate that he was aware of "a very strong movement within the barracks" and the ongoing coup plot.

But instead of reporting this to his peers in the Court and to the competent authorities, Nardes chose to make an appeal to sectors of society politically identified with coup-mongering and anti-democratic acts.

According to Law 8.112 of 1990, the case should already be under formal investigation. Article 143 of the law establishes that "The authority that becomes aware of irregularities in the public service is obliged to promote its immediate investigation, through an inquiry or disciplinary administrative process, ensuring the accused full right to defense."
