Genocidal: always genocidal

The policy of exterminating indigenous people under the fascist government is a classic definition of genocide, writes lawyer Antonio Carlos de Almeida Castro.

When, at the beginning of the pandemic, I called then-President Bolsonaro a genocidal figure, I faced much criticism because there was uncertainty about the technical relevance of classifying the crime as genocide. I recognize that the discussion is serious and we cannot accuse without due basis. I also recognize that many exaggerated their right to criticize the classification as genocide due to an undisguised sympathy for the then-powerful fascist. But, as a lawyer and human rights activist, perhaps I have fewer constraints than my fellow professors and scholars. It's a life choice, and I respect it, although I criticize it.

Now, we are in a different moment, and the discussion about genocide revolves around the deliberate and cruel extermination of the Yanomami people. This time, the penal code seems to have been designed to hold the genocidal Jair Messias Bolsonaro accountable. Just read (Law No. 2.889/1956): 

Article 1. Whoever, with the intention of destroying, in whole or in part, a national, ethnic, racial or religious group, as such: (See Law No. 7.960 of 1989):

a) kill group members;

b) causing serious harm to the physical or mental integrity of members of the group;

c) intentionally subject the group to conditions of existence capable of bringing about its total or partial physical destruction;

d) adopt measures aimed at preventing births within the group;

e) forcibly transfer children from the group to another group;

President Lula is today, unquestionably, the greatest political leader on the planet. The President's visit to the Yanomami Indians will sensitize the world. We will expose to all civilized nations the shame and massacre deliberately coordinated by Bolsonaro's fascist government. The policy of exterminating the Indians under the fascist government is a classic definition of genocide. I return, some time later, to call for a process that condemns this monster who opted for death, who exalted torture, who disseminated hatred and violence. The evidence is there. 

The floor is now open to professors and scholars. The indigenous peoples thank you. Not only them, but all of humanity. Let's go to the International Courts.
