The Chargé d'Affaires of the US Embassy in Brasilia should be declared "persona non grata".
He clearly violated Article 41 of the Vienna Convention on Diplomatic Relations.
The US Embassy in Brasilia issued the following statement today on the X network:
“Minister Moraes is the beating heart of the persecution and censorship complex against Jair Bolsonaro, who, in turn, has restricted freedom of expression in the US. Thanks to the leadership of President Trump and Secretary Rubio, we are vigilant and taking the necessary measures.”
The current Chargé d'Affaires of the U.S. Embassy in Brasilia, Mr. Gabriel Escobar, by disseminating this message, clearly violated Article 41 of the Vienna Convention on Diplomatic Relationswhich provides:
Article 41
Without prejudice to their privileges and immunities, all persons enjoying such privileges and immunities shall respect the laws and regulations of the receiving State. They also have a duty not to interfere in the internal affairs of that State.
Given this clear violation, Mr. Escobar should be declared persona non grata and therefore leave the country. This measure is supported by Article 9 of the same Convention, which establishes:
Article 9
The receiving State may, at any time and without being obliged to justify its decision, notify the sending State that the Head of Mission or any member of the diplomatic staff of the Mission is persona non grataor that another member of the Mission staff is unacceptable. The sending State will, as the case may be, withdraw the person in question or terminate their duties at the Mission. A person may be declared non grata or unacceptable even before reaching the territory of the accredited State.
If the sending State refuses to comply, or fails to do so within a reasonable time, with the obligations incumbent upon it under paragraph 1 of this article, the receiving State may refuse to recognize such person as a member of the Mission.
