Still about Fux's gang
. That Minister Fux, “fux-se”, and remain in the First Chamber
Minister Luís Fux initiated a cycle of political clashes in the Supreme Federal Court by casting a dissenting vote in the trial of the criminal organization led by Jair Bolsonaro, for the attempted coup d'état. Not because of the disagreement itself with the rapporteur and the other ministers of the panel, but because of the frankly hypocritical content, which sought to "blame the butler." Since then, his actions have been interpreted explicitly within the context of political dispute.
It is in this sense that I see his attempt to change Chambers. It is not, obviously, merely a matter of problems of coexistence with his peers in the First Chamber. Especially since the maneuver puts him at odds with his greatest adversary in the Court, Minister Gilmar Mendes, president of that panel. The objective is explicit: Fux seeks to build a bunker in the Second Chamber with the support of ministers appointed by Jair Bolsonaro, who has already been convicted. Only those who refuse to see it can't.
What is most astonishing is that the Supreme Court itself is opening the door to such maneuvering. It seems almost childish – were it not for the deleterious effects it could have on the defense of Brazilian democracy.
Since it is a political gesture, it must be addressed politically. Would it be asking too much for Minister Cármen Lúcia to request a transfer to another Chamber? According to the Supreme Court's Rules of Procedure, being the most senior member of the Court, she would have preference. In any case, let Article 7, item X, of the Internal Rules be enforced, which assigns to the Plenary – therefore, to all ministers – the competence to “grant the transfer of a Chamber.” Therefore, a monocratic decision by President Edson Fachin, of the kind so often questioned by Bolsonaro supporters, is not appropriate.
It is evident that the ministers have already perceived the maneuver underway. It remains to be seen whether they will treat it as a mere administrative matter, nor allow rules of "good conduct" to override the greater interest of safeguarding our democracy. May Minister Fux, "fux-se" (roughly translated as "get lost"), and remain in the First Chamber.
